China's New AI Export Gate: How MiniMax and DeepSeek are Navigating Registration

In a swift response to shifting regulatory landscapes, two of China's most prominent AI labs, MiniMax and DeepSeek, have reportedly become the first developers to complete export registration procedures under a new set of draft rules from Beijing [3]. This movement comes just days after the Chinese government proposed tighter oversight on the transfer of advanced artificial intelligence technologies [1][5].

While the introduction of such controls often signals a closing door, the early approvals for these firms suggest a more nuanced strategy: creating a formalized regulatory gate that allows compliant companies to continue scaling their international presence [2][3]. For the global AI community, this marks a transition where the availability of Chinese frontier models is no longer just a matter of corporate will, but of state registration [4].

The Architecture of the New Export Controls

On October 16, 2026, the Ministry of Commerce (MOFCOM) and the Ministry of Science and Technology introduced draft revisions to the Catalogue of Technologies Prohibited and Restricted from Export [3][5]. This broader update covers 40 technologies, with 23 specifically targeting AI [5]. The restricted list includes critical infrastructure such as computing clusters, AI agents, and large language models [1][6].

Despite the restrictive nature of the catalogue, the framework includes specific mechanisms to prevent a total freeze on innovation. Notably, the rules establish a "fast lane" for open-source projects, which may be eligible for accelerated automatic licensing [3]. Furthermore, the government has indicated that technologies already residing in the public domain through academic papers or open-source releases are proposed for exclusion from these controls [5].

Commentary: This structural approach suggests that Beijing is not attempting to isolate its AI industry, but is instead implementing a "known-entity" system. By requiring registration, the state gains visibility into who is exporting what and where. The focus on "national security" mirrors the export controls seen in the U.S. regarding high-end chips, effectively turning AI model weights into a strategic asset similar to hardware. The real test will be whether the "automatic licensing" for open source remains streamlined or becomes a bureaucratic bottleneck as more labs apply.

The Critical Distinction: Weights vs. APIs

One of the most important aspects of the proposed regulations is the difference between exporting the underlying technology and providing a service [5]. According to MOFCOM, ordinary access provided through software-as-a-service (SaaS) platforms, websites, mobile apps, and APIs generally falls outside the scope of these large-model export controls [3][5].

In contrast, the transfer of model weights—the actual parameters that allow a user to run a model on their own hardware—is viewed as a technology transfer [5]. This creates two distinct paths for international deployment:

Hosted Access: API-based delivery remains largely unregulated, allowing foreign users to interact with models without receiving the underlying technology [3][5].
Local Deployment: Providing weights or technical capabilities to a named overseas recipient may require specific licensing or registration [4][5].

Commentary: This distinction is a strategic move to preserve China's influence in the global AI ecosystem. By keeping APIs open, China ensures its models remain integrated into global developer workflows and SaaS products, which generates revenue and data. However, by controlling weights, they limit the ability of foreign adversaries to study, fine-tune, or permanently host these models independently of Chinese oversight. This creates a "tethered" form of open-source adoption where the convenience of the API is used to maintain a level of centralized control.

MiniMax and DeepSeek: The First Movers

MiniMax and DeepSeek moved rapidly to secure their status under the new regime. By October 22 and 23, state-affiliated media reported that both companies had completed the necessary registration procedures [1][3]. MiniMax formalized this via a filing on October 23, covering both currently released and upcoming models [4].

For DeepSeek, being an early adopter is particularly significant given its high global visibility and the closing of a significant private funding round [3][4]. The speed of these approvals—occurring roughly a week after the draft was released—serves as a signal to other domestic developers that the registration process is viable and potentially efficient [3].

Commentary: The haste with which these two firms registered is likely a calculated business move to reduce "geopolitical friction" for their investors and international partners [4]. For a company like MiniMax, which is actively pursuing enterprise sales in the EU, UK, South Korea, and the US, regulatory certainty is more valuable than the absence of regulation [4]. By being the first to clear the gate, they establish a template for compliance that other labs will likely follow to avoid the risk of sudden enforcement actions.

Implications for Global Developers and Founders

For international startups and enterprises, the new registration layer adds a necessity for deeper due diligence. While existing public releases are not automatically banned, future updates or private transfers of restricted technology may face new hurdles [5].

Founders building on Chinese open-weight models now face several risk scenarios, including potential retaliatory measures from the U.S. or sudden shifts in the final text of the MOFCOM catalogue. As part of the standard draft process, the catalogue remains open for public comment until November 15, 2026 [3][4][5]. Experts suggest that companies should document whether they are utilizing models via API or self-hosting, as the regulatory treatment for each differs significantly [4].

Commentary: We are witnessing the end of the "borderless software" era for frontier AI. When the weights of a model are treated as a controlled export, the software license (e.g., Apache 2.0) becomes secondary to the national export license. International developers should diversify their model providers to avoid a single-country dependency; relying solely on a regulated export from one jurisdiction introduces a systemic risk that could shrink an addressable market overnight if diplomatic relations sour [4].

Key Takeaways

New Regulatory Gate: China has proposed export controls on 23 AI-related technologies, requiring registration for overseas transfers [1][5].
Early Compliance: MiniMax and DeepSeek are the first to complete registration, signaling a path for other labs to maintain global access [2][3].
API Safe Harbor: API and SaaS access are generally exempt from these controls, whereas the transfer of model weights is regulated [3][5].
Open Source Priority: The government has indicated that existing public releases and certain open-source projects may receive accelerated or automatic licensing [3][5].
Deadline for Input: The draft catalogue is under public consultation until November 15, 2026 [5].
